Hajj Quota Case Decision 2017 – Sindh High Court Karachi Cause List Dated Tuesday, May 9, 2017 Today
Today again is the hearing of the application pf Hajj organizers association of Pakistan. This case is about the quota of the hajj for the year 2017 AD / 1438 AH.
In the hajj policy 2017, Government of Pakistan, Ministry of religious affairs and interfaith harmony aprroved the hajj quota at the rate of 40:60. The 40 percent quota for the private hajj tour operators and 60 percent quota for thr Govt. hajj scheme.
But Hajj organizers association of Pakistan has refused to accept the decision and decided to taken up matter in the Court of Law.
They moved an application in the Sindh high court, Where the proceeding i being held under the head of single bench. Mr. Justice Muhammad Ali Mazhar is heading the proceedings.
IN today’s daily cause list of original side this has been mentioned in the serial number 1. M/S Abid S. Zuberi and Co. and Ayan Mustafa Memon is pursuing the case from petitioner sides. While Jehangir Ishtiaq and Muhammad Fazal e Rabbi is from federation of Pakistan.
What will the outcome of this case. We are waiting for the judgement of the honorable justice Mr.
Muhammad Ali Mazhar.
Almost 18000 hajj applicants are waiting for the orders.
Who are praying for their success and ready to go on the journey of Hijaz-e-Muqaddas.

While applications has been required from the Govt employees quota also. Hajj substitution applications has been also invited.

Depressing to know that decision is again delayed. This is a serious case related to a large number of people but its much annoying to know that after deferring it till 17th May now its again deferred till 23rd May. Now if again its contested by any party in Supreme Court than whats going to happen with this case?

100% quota should be with Government, as government is not only organizing it good but also in a very low rate as compared to private hajj operators, where minimum is Rs. 475,000 without Qurbani. People are being looted. Courts must care and consider general public interest and not the businessman interest.

Joke is being played with all of those in waiting list. If Judge was on leave today; case should have been taken up tomorrow. Supreme Court should take it up and decide the fate. There is absolutely no justification of 50-50% quota as private schemes are expensive. Govt scheme should have 80% quota. Private Hajj operators make lot of money out of it and our honorable courts should know about it. In the name of justice this case should not have been admitted for hearing. All of us in waiting list are much worried due to these delays. Ministry should take this case to SC or let us make out an application and knock the doors of SC for justice. We request Chief Justice of Pakistan and intervene and decide this case in this week. Every passing day is agonizing for those in waiting list. Private Hajj operators are just hanging on and delaying. In the name of Allah we request the whole judiciary to decide this case. The long wait is killing.

Bha agar kisi ka media mein koi jannay wala hai tu wo us ko approach kare aur jis ka koi judge hai wo us se mashwara kare aur jis ka jahan tk bs chal sakta hai zaroor koshish karo. Please try ur best to take ur right.
Even if we go to SC now; hearing cannot be fixed before 23rd May. However all those in Karachi who are in waiting list should visit HC and request Judge Sb to decide the case. If anyone has connection in Hajj Ministry he/she should request them for early decision. I am of the opinion that this petition of private Hajj operators should not have been admitted in the first place. Registrar SHC is responsible for this. If this case is delayed further there would slim chances of persons on waiting list as Govt has to make arrangements in Makkah, Madinah and Mina what to talk of flights.

Today I contacted the hajj wing of MORA in I Islamabad and they told me that based on the decision of the supreme court on 17th of this month in a contempt of court case against MORA 60-40 quota remains intact and hence waiting list will be declared successful in couple of days Insha Allah. No need to wait for sindh high court.
As per my understanding this decision states that MORA and govt has the right to change quota policy. Private hajj operators cannot claim that they have got that 50 percent quota as a matter of right. There are two types of hajj operators new and old while court also directs that both new and old should get justified quota from tthe alloted quota to hajj operators.
That is great! Alhamdollilah. May Allah SWT grant all of the Hujjaj Hajj-e-Mabroor.

From very first day of Hajj Quota Case, now I come to know that:
[ Decision will be positively made on the basis of deal between Judge and private Hajj tour operator. When judge will receive money as per his demand then he will make decision in favour of private hajj tour operator because in this case there is no need of investigation for evidence and delay is only for money. ]
So I humbly request to all applicant who are in waiting list, kindly pray that Hajj Quota case should be transferred to other Judge who have sympathetic heart and have ability to make decision on justice basis.
ONLY THOSE JUDGE/ PERSONS ARE LIVE IN HISTORY WHO MAKE DECISION ON MERIT BASIS.
If supreme court is instructing ministry to reframe the policy for HGO against 40% quota that mean supreme court is declaring HGO have/should have 40% quota.
Also supreme court comments over HGO’s “MONOPOLOY” gives negative impression of HGOs, then how Sindh high court still can favor 50% quota to HGO,

13. As regards the judgment dated 03.5.2016 rendered in
HOAP’s case (supra), and relied upon by Mr. Abid Zuberi, it may be
crucial to note that the learned Judges, while rendering the said
judgment, have in their wisdom found it necessary to mention in the
judgment itself, that the same “may not be cited as a precedent,
which would debar the government from exercising” their “exclusive
powers to review/reframe the Hajj policy every year, keeping in view
the latest developments and expediencies, which would be subject to
the guidelines given by this Court in Dossani’s case (supra)”, and
that “there would be no restriction on the government to alter or vary
the Hajj policy (quota system)”, and therefore the decision as
contained in the said judgment, or any observation made therein, do
not stand in the way of the government in framing a just, fair and
lawful Hajj policy, and the same certainly does not come in the way of
this Court in passing an appropriate order in the instant matter. The
said judgment has in fact sanctified and reinforced the judgment in
Dossani Travels’ case which required the government to frame future
Hajj policy as directed therein and non-compliance, rather defiance
whereof has provided a cause of action for the present petitions.

The information available on net shows the statistics that every time the Private Tour Operator has challenged the Haj Quota Policy of Govt. The Govt has lost the case. Personally I will accept that PTO are more powerful than Mora(Ministry of Religious Affairs) in any kind of resources they use to out-turn courts decisions in their favours but MORA should learn from their mistakes, they made in previous Hajj Policies in shape of errors or omissions. The Haj Policy should now be converted to Haj Act due to the reason people are keen interested in Govt Haj Scheme. The listening people must not be baby-dolls in front of 3 crore lawyer; you are the people who will be under Allah shade at the Day of Judgment. The facts are converted into wordings which seem harsh now.
In past years, decision of SHC is always in favor of Government. HOAP appeal to SC converted it against Government. See what happened this year.
I remember a number of occasions when unexpected results are seen. Strong hope, ALLAH will accept our (on waiting list) DUAs and we will perform Hajj this year.

According to the latest updates as per the official website of the high court of Sindh Karachi, Today did not proceeded and next date of hearing will be June 1st, 2017 (Thursday). So my dear government hajj applicants in waiting mode, please wait for two more. Dont be worry. Insha-Allah the decision will be in favor of you. As the minister of MORA Mr. Sardar Muhammad Yousaf has told the waiting list applicants to prepare for the hajj. His statement has been published in the press while he was addressing to the hajj Training session in Islamabad/Rawalpindi.

Decision has to be announced before both parties; normally another date is given for announcement. If decision is reserved, this means that further delay is inevitable. It is like playing with religious sentiments of Muslims. Justice delayed in justice denied. True!
There is no point in reserving such decision. It does not have any political underpinnings. I think we should raise our voices on media. And also send an application to CJ SC to take notice of these delays.

Absolutely right. Everyone of us should contact media channels and try to raise voice against this gross mismanagement of case by concerned Judge. He was not present on two hearings and as per website of SHC case is pending for orders since last six hearing dates. This case should not have been admitted for hearing in the first place. 40 days have passed and no one is pushed to decide the case. 18000 people are going through worst mental agony!

Hajj Quota Case Decision 2017 – Sindh High Court Karachi Cause List Dated Tuesday, May 9, 2017 Today
Today again is the hearing of the application pf Hajj organizers association of Pakistan. This case is about the quota of the hajj for the year 2017 AD / 1438 AH. In the hajj policy 2017, Government of Pakistan, Ministry of religious affairs and interfaith harmony aprroved the hajj quota at the rate of 40:60. The 40 percent quota for the private hajj tour operators and 60 percent quota for thr Govt. hajj scheme.
But Hajj organizers association of Pakistan has refused to accept the decision and decided to taken up matter in the Court of Law. They moved an application in the Sindh high court, Where the proceeding i being held under the head of single bench. Mr. Justice Muhammad Ali Mazhar is heading the proceedings.
IN today’s daily cause list of original side this has been mentioned in the serial number 1. M/S Abid S. Zuberi and Co. and Ayan Mustafa Memon is pursuing the case from petitioner sides. While Jehangir Ishtiaq and Muhammad Fazal e Rabbi is from federation of Pakistan.
What will the outcome of this case. We are waiting for the judgement of the honorable justice Mr. Muhammad Ali Mazhar.
Almost 18000 hajj applicants are waiting for the orders. Who are praying for their success and ready to go on the journey of Hijaz-e-Muqaddas.

Hajj applicants who were declared successful on 28th April has submitted their passports in the Banks branches. Last date to submit Passports and a Photograph is tomorrow Wednesday, May 10, 2017. While applications has been required from the Govt employees quota also. Hajj substitution applications has been also invited.
It is expected that decision might be announced on Monday, June 5, 2017 Positively.

This case is not on cause list; so there won’t be any decision today. Very frustrating.

Ministry is as ignorant as we all are! Plus it is not interested in expediting the decision. Under the circumstances, it seems that decision will be in favor of private Hajj operators. Ministry of Hajj are in win-win situation. Poor waiting listing applicants will suffer as they are ordinary citizens of this independent country.
Case is not on cause list for tomorrow. So do not expect decision tomorrow. It seems that Judge Mazhar has gone on vacations.

Instead of adding people on whatsapp; people should go to SHC with a placard saying “Please decide the fate of public put on waiting list by Ministry of Hajj”. Just protest silently, it will automatically catch the eye of media. Just 5-10 people would be good enough to protest. And this is also legal. No slogan, nothing just hold this placard in your hands. Cost is also not more than Rs.400/-.
To me, this decision has already been given in favor of private operators.

There are two case
1. Distribution of 40% pvt quoya to 2000 pvt tour operators. Because some new pvt operator not got any quota from govt and they complain to SC. So supreme court question and instructed govt to reframe policy and distribute this 40% to new pvt operator as well.
Yesterday SC discusses this matter and it is in dawn news and may be other as well. It is not about our case of 60:40

ISLAMABAD: The Supreme Court on Wednesday ordered the government to reformulate the Haj policy for 2017 by accommodating the private tour operators that had earlier been denied quota.
A three-judge bench of the court headed by Justice Ejaz Afzal Khan asked the Ministry of Religious Affairs (MoRA) to formulate the policy in such a way that no Haj Group Organiser (HGO) suffered on account of being a comparatively new or junior entrant to the market.
The verdict came in a case involving petitions that sought initiation of contempt of court proceedings against the ministry for not implementing the Haj policy for 2015-16, and which were filed on behalf of the HGOs denied the quota.
Instead of distributing quotas meant for the private sector among all the HGOs, the ministry gave all of them to members of the Haj Group Organisers Association of Pakistan (HOAP), thus depriving the petitioners of their participation in Haj activities this year in clear violation of the earlier Supreme Court judgements, according to the petitions.
ISLAMABAD: The Supreme Court on Tuesday ordered the government to maintain its earlier direction of keeping the Haj quota for private tour operators at 40 per cent from the earlier 50 per cent.

Thanks! but confusion still prevails as this case is subjudice in SHC. I do not think SC will intervene till SHC decides the case. But SHC has delayed this case too much; still no day has been fixed to announce judgment. Judge Mazhar is not on any cause list for last three days. It is time that this issue is taken up in media. Even one placard before SHC held by one person will do the job.
I dont know what is the confusion? these are two different cases. one was in supreme court, filed by new private hujj operator against old private hujj operator demanding for equal distribution of hujj couta instead of 60/40 between them.
the second case is in sind high court which is filed by all private hujj operator against govt to disutirbute 50, 50 couta between govt and private instead of 60/40.

Case is not SHC cause list today so no decision today. Judge Mazhar is not on any cause list. Decision reserved for indefinite period.
Case is also not on cause list for June 9, 2017. It seems as if Ministry of hajj is also not interested. Afridi Bhai, if SC has decided then why Ministry of Hajj is not issuing sms to all those on waiting list.

According to my information if any case decision is reversed then it will not be necessary to be on cause list. The Judge can disclosed the judgment with out any case list..

اسلام آ باد ( رانا غلام قادر ) سیکر ٹری وزارت مذہبی امور کی زیر صدارت اجلاس میں فیصلہ کیا گیا ہے کہ حج کوٹہ کی تقسیم میں گورنمنٹ اسکیم کا حصہ 60فی صد ہی رکھا جائے گا۔یہ فیصلہ بدھ کو اعلی سطحی اجلاس میں کیا گیا جس میں ایس ای سی پی اور وزارت قانون کے نمائندے بھی شریک ہو ئے۔ اجلاس میں رائے دی گئی کہ سپریم کورٹ کے فیصلہ کے مطابق نئے ٹور آپر یٹرز کو بھی حج کوٹہ د یا جا ئے گا ۔اس وقت پرانے ٹور آپریٹرز کی تعداد 742 ،نئے رجسٹرڈ ٹور اپریٹرز کی تعدا د2033 ہے ۔ سپریم کورٹ نے فیصلہ سنا یا ہے کہ وزارت مذہبی امور 40فی صد میں سے نئے ٹور اپریٹرز کو بھی کوٹہ دے۔ اجلاس نے رائے دی کہ سپریم کورٹ کے تحر یری فیصلے کا انتظار کیا جا ئے جو جمعرات کو متوقع ہے ۔اجلاس میں فیصلہ کیاگیا کہ پر ائیو یٹ حج سکیم کا کوٹہ شفاف انداز میں میرٹ پر الاٹ کرنے کیلئے نئی پا لیسی وضع کی جا ئیگی،یہ تجویز ہے کہ عازمین حج کو سستے پیکج پر حج کی سہولت دینے کیلئے حج کوٹہ پیپرز رولز کے تحت اوپن آکشن کے ذ ریعے ان ٹو ر آپریٹرز کو دیا جا ئے جو کم سے کم حج پیکج دیں ، اس سے حکومت کی نیک نامی ہوگی اور لاکھوں عازمین کو فائدہ ہو گا۔ اوپن ٹینڈر کیوجہ سے مسابقت کی فضا پیدا ہوگی ، سستے پیکج سامنے آئیں گے اور نا جائز منافع خوری کا خاتمہ ہو گا۔

I would like to congrats all the brothers and sisters who were in waiting list, i just heard from a close friend that court has given the decision in favor or GOVT and the 10% citizen who were in waiting list will IN SHA ALLAH perform hajj this year from the platform of government. Similar confirmation got from bank yesterday who said that official announcement is awaited and we will contact you after getting formal decision confirmation.

اسلام آباد : حج کی سعادت حاصل کرنے کی تمنا لئے جو سرکاری اسکیم کی ویٹنگ لسٹ میں لٹکے تھے، انہیں سپریم کورٹ کے حکم پر کامیاب قرار دے دیا گیا، اب مزید ساڑھے 17 ہزار پاکستانی عازمین کے قافلے میں شامل ہونگے۔
خانہ خدا اور روضہ رسول ﷺ پر حاضری کی تڑپ رکھنے والوں کی دعائیں قبول ہوگئی، وسیلہ عدلیہ بنی اور عازم حج بننے کی سعادت نصیب میں آئی۔
سرکاری اسکیم کی قرعہ اندازی میں 28 اپریل کو جن 17 ہزار 563 درخواست گزاروں کو ویٹنگ لسٹ پر ڈال دیا گیا تھا اب انہیں طواف بیت اللہ اور نظارہ گنبد خضرا کا بلاوا آگیا۔ وزارت مذہبی امور کے ترجمان کا کہنا ہے یہ فیصلہ سپریم کورٹ کے احکامات کی روشنی میں کیا گیا ہے، اطلاع بذریعہ خطوط اور ایس ایم ایس خوش نصیب افراد تک پہنچائی جائے گی۔
سرکاری اسکیم کے تحت 10 فیصد کوٹے کا فیصلہ عدالتی احکامات سے مشروط ہونے پر درخواستگزاروں کو ویٹنگ لسٹ میں رکھا گیا تھا، رواں سال 3 لاکھ 38 ہزار 696 خواہشمندوں نے سرکاری اسکیم کے تحت حج درخواستیں جمع کرائیں، جن میں سے ایک لاکھ 7 ہزار 526 عازمین کامیاب قرار پائے، 40 فیصد کوٹے کے تحت 71 ہزار 684 عازمین پرائیویٹ حج ادا کریں گے۔ سماء

لاہور(ڈویلپمنٹ سیل) ہوپ اور وزارت مذہبی امور کے درمیان ڈیڈ لاک اور سرد جنگ کا خاتمہ معاملات طے پائے جانے کا امکان خیر سگالی کے جذبے کے تحت ہوپ سندھ ہائی کورٹ میں دائر کی گئی رٹ واپس لے سکتی ہے معلوم ہوا ہے عدالتی جنگ کی وجہ سے پرائیویٹ حج سکیم میں ہونے والی تاخیر کی وجہ سے وزارت مذہبی امور اور ہوپ نے حج اپریشن 2017متاثر ہونے سے بچانے کے لیے باہمی مذاکرات سے مسائل حل کرنے کا فیصلہ کیا ہے ہوپ نے آگے بڑھتے ہوئے سندھ ہائی کورٹ میں بحال ہونے والا کوٹہ سرکاری سکیم میں شامل کر نے کے خلاف دائر رٹ واپس لینے کی تجویز دی ہے وزارت کی طرف سے بھی خیر مقدم کیا گیا ہے پرائیویٹ سکیم کے حجاج کی بہتری کے لیے مل کر کام کرنے پر اتفاق کیا گیا ہے مذاکرات جاری رہیں گے۔

There is process for taking back petition from High Court. Instead, Government and we people who are at stake should urge SHC to decide the case. Remember decision was reserved was Judge Mazhar. I have sent two emails to regsitrar@sindhhighcourt.gov.pk urging him to fox date for decision announcement. At least people in this group can send emails to registrar sindh high court requesting him for decision. It is simply not understandable that how can a Judge of High Court delay such kind of sensitive case, especially where he has reserved decision. It is such a pity! Fair and speedy justice is basic right of citizens. It is our constitutional right to urge this Judge and judiciary overall to provide us speedy justice.
